Terms and Conditions for iCuraConnect

Welcome to iCuraConnect! By accessing or using this platform, you agree to abide by the following Terms and Conditions. Please read them carefully before proceeding.
1. Acceptance of Terms
By registering, accessing, or using iCuraConnect, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree, you may not use the services provided by the platform.
2. Scope of Services
iCuraConnect facilitates telemedicine services, connecting patients with licensed healthcare providers for:
- Critical Care Consultations
- Outpatient Department (OPD) Appointments
- Emergency Medical Advice
- Ward Consultations
- Audio/Video-Based Medical Consultations
Note: iCuraConnect is a telemedicine facilitation platform and does not itself provide medical diagnosis or treatment.
3. User Obligations
3.1. Account Registration
- Users must provide accurate, complete, and up-to-date information during registration.
- Any misrepresentation may result in suspension or termination of the account.
3.2. Age and Consent Requirements
- Users must be at least 18 years old to create an account.
- Minors can use the services only with explicit consent from a parent/guardian.
- Written consent is required from patients or their guardians before any telemedicine consultation, including audio/video consultations.
3.3. Prohibited Activities
Users agree not to:
- Misuse the platform for non-medical purposes.
- Provide false medical information or impersonate another person.
- Violate any applicable laws, including telemedicine regulations.
4. Telemedicine Consultation Process
4.1. Audio/Video Consultation Policy
- iCuraConnect enables teleconsultations through video, audio, and chat-based interactions.
- Video consultations are required for certain medical conditions, based on government-mandated guidelines.
- Consultations may be recorded for legal and quality assurance purposes (with patient consent).
4.2. Signed Consent Requirement
- Before any telemedicine appointment, the patient (or their guardian) must provide signed consent via the platform.
- Users will receive a digital copy of their signed consent form for reference.
4.3. Emergency Situations
- iCuraConnect does not handle life-threatening emergencies. In such cases, users must seek immediate in-person medical care or contact emergency services.
5. User Code of Conduct
To ensure a safe and professional environment, all users (patients, doctors, and staff) must adhere to the following:
5.1. Respectful Communication
- Users must treat doctors, staff, and other users with respect and professionalism.
- Abusive, offensive, or harassing language or behavior is strictly prohibited.
5.2. Honesty and Integrity
- Users must provide truthful and accurate medical history and information.
- Fraudulent activity, impersonation, or misrepresentation will lead to account termination.
5.3. Confidentiality
- Users must respect the privacy of doctors and other patients.
- Any unauthorized recording or sharing of consultations is strictly prohibited.
5.4. Compliance with Laws
- Users must comply with all Indian telemedicine laws and regulations.
- Any misuse of prescriptions or medical records will be reported to authorities.
6. Doctor-Patient Confidentiality Agreement
iCuraConnect follows strict doctor-patient confidentiality protocols, ensuring patient privacy and data security.
6.1. Confidentiality Commitment
- All medical consultations are private and confidential.
- Doctors and platform administrators must not share patient information without explicit consent, except in cases required by law.
6.2. Exceptions to Confidentiality
Confidentiality may be overridden in the following cases:
- If the patient poses a threat to themselves or others.
- If required by law enforcement or court orders.
- If reporting notifiable diseases as per Indian health regulations.
6.3. Data Security
- All patient data is encrypted and securely stored.
- Consultation data is not shared with third parties without explicit patient consent.
7. Specific Terms for Prescriptions & E-Prescriptions
7.1. Prescription Policy
- Prescriptions are issued only after a legitimate doctor-patient consultation.
- Certain medications (e.g., narcotics, psychotropic substances, and Schedule X drugs) cannot be prescribed through telemedicine as per Indian laws.
7.2. Validity of E-Prescriptions
- Digital prescriptions issued through iCuraConnect are legally valid under the Telemedicine Practice Guidelines (2020).
- Patients must download and retain a copy of their prescription.
7.3. Prescription Misuse and Compliance
- Altering or forging prescriptions is strictly prohibited and will result in legal action.
- Pharmacies may verify prescriptions using the secure prescription tracking system provided by iCuraConnect.
8. Data Retention Policy
8.1. Duration of Data Storage
- Medical records and consultation data are stored for at least 3 years, as per Indian telemedicine regulations.
- User account details are retained as long as the account remains active.
8.2. Deletion of Data
- Users can request account deletion, but medical records may only be deleted after the legally required retention period.
8.3. Data Security
- iCuraConnect employs advanced encryption and secure cloud storage to protect patient data.
9. Governing Law and Compliance
- These terms are governed by Indian law, including:
- Telemedicine Practice Guidelines (2020)
- Information Technology Act, 2000
- Indian Medical Council Regulations
- Any disputes will be resolved under the jurisdiction of Indian courts.
10. Amendments to Terms
- iCuraConnect reserves the right to update these Terms and Conditions.
- Users will be notified of significant changes via email or platform notifications.
